<p><strong>Overview</strong></p>
<p>Despite legislation, fair pay between one worker and another does not always exist in the workplace.  Often, this form of discrimination still happens between the sexes with women still marginalised in terms of pay and benefits.</p>
<p>For this reason, equal pay claims can take the form of sex discrimination claims centring on pay, benefits, and bonuses.  It can often be difficult to separate an equal pay claim and a sex discrimination claim, so for this reason it is standard practice to make two claims on both grounds.</p>
<p>The Equality Act of 2010 known as (‘The Act’) states a criteria where women can claim against their employer for equal pay.</p>
<ul>
<li>‘Like work’.  This term is used to describe one job role which is more or less the same as another.</li>
<li>‘Work rated as equivalent’.  This term is where two or more job roles undergo an analytical job evaluation.  If one role is rated similar to another then grounds for a discrimination claim exist.</li>
<li>‘Work of equal value’.  This term referrers to two job roles which despite being quite different have the same demands.</li>
</ul>
<p><strong>What does the Equality Act 2010 (‘The Act’) refer to</strong>?</p>
<p>‘The Act’ refers to wages, salaries, bonuses, overtime, additional contracted payments such as shift pay, sickness pay, holiday pay, occupational pension, health insurance, and contractual bonuses.</p>
<p><strong>Establishing ‘like work’</strong></p>
<p>For an employee to establish discrimination on this basis, the employer has to show that the work they are doing is more or less the same as another, and that gender issues are not important to the job roles.</p>
<p><strong>Establishing ‘work rated as equivalent’</strong></p>
<p>For an employee to prove the job they do is equivalent to that of a better paid colleague, then both jobs have to go through a job evaluation study.  If the study shows the employee’s job is ‘equivalent’ to that of their colleague they have a case.</p>
<p><strong>Establishing ‘work of equal value’</strong></p>
<p>Establishing ‘work of equal value’ is arguably more difficult than the other two.  This aspect covers a situation where although two jobs are quite different, they still require a similar level of skill, decision making, and effort to complete.</p>
<p>Often, when cases are fought on these grounds, experts are called in to grade and assess the job roles to decide whether they of equal value on the criteria outlined above.</p>
<p><strong>How to Make a Claim</strong></p>
<p>For an employee to claim they are paid less than a colleague on gender grounds, they have to be able to do the following:</p>
<ul>
<li>Identify a person of the opposite sex who works for the same employer or an associated employer who they feel earns more than they do because they are of the opposite sex.  The person they identify is called a comparator.</li>
<li>Should the comparator work at a different site, the employer is obligated to provide terms and conditions which are common for both the comparator’s site and the employees.</li>
<li>The comparator does not have to work for the company at the same time as the employee.  They may have worked for the company prior to the employee joining, for example.</li>
<li>It is possible for the employee to choose more than one comparator, though the more comparators involved the more complex the claim can become.</li>
<li>A comparator has to be a real person and cannot be hypothetical</li>
</ul>
<p>If the employee feels they are being underpaid due to their gender and there is no one available they can identify as a comparator, they can still claim under sex discrimination rather than equal pay.  Sex discrimination claims do not require a comparator.</p>

<p>This can be done through using a tool such as Google Analytics, to see what posts are looked at and most read. We can also analyse  what posts earn the most questions and comments, and through watching trends in our chosen field. </p>
<p>Conversely, looking for opposite trends and seeing what posts earn the least interest is just as important. Thankfully, we can use the same methodology as looking for the most popular items on our blog. </p>
<p>In effect what you are doing is identifying your blog's unique selling point. This is what sets your blog apart from thousands of others which are out there on the web. </p>
<p>Good Practice </p>
<p>Make a list of the popular items over the last six months and expand these posts. They will more than likely be popular among your readership. </p>
<p>Do a little research as to what is popular and what is likely to be popular very soon in your chosen field and do a few pieces about it. </p>
<p>It is worth identifying what is important to your readership as this will make your work more relevant and more appealing.

			<content:encoded><![CDATA[<p>Maybe it's the time of year, but today I was thinking about phrases and words that I can distinctly remember from my childhood. The one that has stayed with me the most is the word keenly. Meaning poignant. </p>
<p>I can clearly remember coming across the word at secondary school, and one of my teachers explaining the meaning. </p>
<p>For some reason, it has stayed with me. I guess it is a good example of the power of words. </p>
<p>I'm off to bed. I want this night to go fast so I can open my presents.
